Here's some drama for you sweethearts.
I've posted a little about the shitty area of the shitty town I live in. I'm there because it's rent free.
My boss is also my landlord, and an old friend. I work in the basement of his office (kinda like the guy in Office space who obsesses over his stapler), so I'm at work with the guy that owns my apartments.
The police called him. They told him that *my* apartment had been robbed, and they caught the guy who did it.
I've had things stolen from me before. When I was in the military, somebody stole my favorite flight jacket, my cd player, and my bike (on three different occassions). To be sure, it's frustrating, but in those cases, it wasn't frightening, because when you're on an Aircraft Carrier, you're basically living in a huge city, and sailors, let me tell you, aren't exactly the most couth of people. It just comes with the territory.
But this was different. This was an older black man. I have never seen him or heard of him or talked to him before.
Since my lock is broken, I had been unable to lock my front door, which is not a good thing in the best of neighborhoods, much less in da hood where I'm at now. I haven't been overly concerned about it, however, because my ex-wife cleaned me out and left me high and dry anyway (the hoor).
But I have a few things of monetary value left, most notably my guitars, my television, my computer and a few other little things like that.
My friend comes down and tells me I'd been robbed.
The fucker had the audacity to walk up to my front porch try the lock, and just walk into my house, in broad fucking daylight, unknown and uninvited. How he knew I wasn't home I don't know, but for all he knew I was hiding in there with a bazooka ready to blow some Negro trespassing intruder muthafuckin' head off.
Fortunatly my neighbors across the street knew he had no business there, and the wife the husband who then called the police on his cell, and then proceeded to follow the old theif down the block.
It was odd, his choice of item to steal. I am the proud owner of a really great set of tools, given to me by my dad when I was first starting out in the world. While I was never particularly fond of my pop, I love those tools. They've saved my ass on so many occassions I could write posts about that alone for years to come, but, since I'm a nice guy, I'll spare you.
The fucker took my tools. And nothing else. Don't you think that's a little weird? I mean I know he could probably get $100.00 or so for them at a pawn shop, but wouldn't he have been better off with my two guitars? Or the small television? Or something along those lines?
Anyway the cops surrounded the fucker in the parking lot of a Domino's pizza not far from my place. I had to go down to the police department, stand around with my thumb up my ass, sign all kinds of documents proving I'm me, wait some more, then finally get my tools back.
I still have to decide whether or not to prosecute. I don't see much point in it, but the cops really want me to press charges. He's just a tired old drunk street bum. A friend here told me that I should prosecute because it'll put a roof over his head. Maybe so.
But the problem is, I feel so violated right now. I think I have a small smattering of what a rape victim must feel. Don't get me wrong. I'd much rather be robbed than raped, and I'm not making a comparison. But I do feel like somebody has peered into my soul and I can never get them out.
Anyway, whaddaya think? Should I prosecute or just let the whole thing go. I mean I know at least he'll never come back and rob me again.

My car got broken in to once in the middle of the night. I woke up on the bastard having fun with my stereo, I screamed like the little girl I am and he ran away with some crappy cds, leaving my Amp and a GPS in the front seat. I rushed outside and walked the entire neighborhood with a metal rod in my hand just wishing I would run in to him, with no luck sadly.
Prosecute the bastard.

I used to live out in the country, miles from the nearest neighbor, and was robbed 5 times...with an alarm and security cameras!...bastards....anyway, send that asshole up the river...I've sent 4 out of 5 thieves to jail, one of them did 2 years just for kicking in the door and never actually going in the house (alarm went off).
I cannot stand a thief, I don't care what "problems" they have, they don't have the right to steal from me...anyway, I'll stop ranting now.

You never know with courts, his history, blah blah blah.
There are a whole lot of factors involved in how the DA would proceed with this case.
And depending on your States specific statutes, he could be looking at a lot of years.
In Nevada, and the way you described the case, the guy committed Burglary, Grand Larceny (assumming that the value of the tools was more than $250) and depending on how the arrest went down maybe some resisting arrest.
Now, given that this guy is a bum and probably cannot afford an attorney, a Public Defender will be appointed for him. This means that the PD will probably just walk him through a plea with the DA.
If this guy has a record, chances are the DA will press foward with the original charges. In Nevada, burglary carries a mandatory 2-10 year sentence, and the grand larceny is 6 months - 12 months. So, if the charges stick in court, chances of a light sentence is minimized.
One more thing. In Nevada, you wouldn't have a choice if charges were filed or not. The police do their report and send it to the DA. The DA makes that determination, whether you want the guy charged or not. If the DA wanted your testimony, you get subpoenaed. You dont show, you are in contempt.
And really, how much testimony are you really going to have to do?
"Yes, those are my tools" thats about it.
and the guy will probably plea out anyway.

I'd prosecute, laws are there for a reason, and they should be obeyed.
P.S. He probably took the tools so it wouldn't look like he just had robbed someone. If they see a guy carrying a TV, or several guitars in the ghetto, the police will stop them (if they are seen).
