I want to delete my account/get rid of every post I've ever created. I'm pretty sure that I don't have to be eternally responsible for posts I did at the age of 16. I have no interest in this site anymore. I will continue to bug Bart via email, posting, etc. until this goal is accomplished. Bart, please delete my account immediately. I've sent you numerous emails about this with no response.

This has maybe already been said, but I'm not reading all the ratings.

There is absolutely NO WAY that he will delete your account. Period. Because if he did, then he would receive so many emails from other people on the site asking to delete posts, accounts, etc, that it would be ridiculous.

MAYBE if you got a lawyer and took him to court, it would get deleted. But my suspicions are that your account will not get deleted otherwise.

We run into this at work all the time. The answer is "You submitted this information of your own free will, with a clear desire that it be displayed. We will continue to do so, in compliance with all currently applicable regulations." There is no requirement that someone be allowed to change something they have already posted.

The license is to display the posting, not to prevent you from editing or deleting it. Bart doesn't own the post, as he has not exchanged anything of monetary value. I'm not on this kids side, I'm just saying that the net is the wild west, and implied license doesn't really cover this situation, as implied license seems to be geared for 3rd party viewing, not as an agreement between server and author.

If there is an implied license to the viewer there is also an implied license to the server, otherwise there is no viewer. I hope that simple concept doesn't escape your grasp, tate. By posting your content on someone else's server (with the intention that others will see it), you are granting them a license to display it in its original form, that is, without modifying the content.

That is covered, in very non-legalese, in the About Us link. "The content of Ubersite is created by anyone who wishes to create content for Ubersite. " Since one would theoretically read that before signing up, one IS granting Bart an implied license to display the information.

It is ultimately no different than when one comments on a news story. They do not allow you to go back and delete your comments. They do not allow you modify them. But by posting it, you have granted them a license to display to anyone who reads it.

This case would only make it to court if someone were stupid enough to shell out actual cash for lawyer/court fees to get something off a backwater internet web forum that will probably blink out of existence in the next few years anyway. Tag that with the fact that if this sort of thing did go to court, some geek would mirror everything on the site just to be an asshole, and you have a clear case of "it's not going to happen." It's called heat whoring.

This... doesn't really make sense.

I'm well aware that there are two sides to an implied license, but I was pointing out that applied license doesn't seem to apply here. There was no purchase of the material, and implied license in regards to the internet does not cover individual posts on a forum, just reading the forum itself.

If an artist was to post a picture of one of their paintings to show it was for sale, then the implicit license is to VIEW the picture, not print it out and frame it. Nor would the implicit license prohibit them from removing the picture after the piece was sold.

Just to play devil's advocate, Hadly, but it would appear that implied copyright doesn't apply here. An excerpt from http://www.bitlaw.com/copyright/license.html:

"A commonly discussed scenario where implied licenses are destined to play a major role is on the World Wide Web. When a Web page is viewed in a Web browser, the page is downloaded through the Internet and placed on the user's screen. It is clear that a copy of the Web page is being made by the user. It is also clear that the Web page is protected against unauthorized copying by copyright law. But it would not make sense to allow the author of a Web page to sue a user who viewed her page, since the author intended that the page be viewed by others when she placed it on the World Wide Web. Rather, attorneys argue, courts should find that the Web page author has given end users an implied license to download and view the Web page. The extent of this implied license is unclear, and may someday be defined by the courts."

It's not an argument that he posted something on a website to be read by 3rd parties, but an argument that he wants to now delete what he posted. In the sense of a web page, the author has full right to post, edit, and remove material.

Additionally, implied copyright seems to be applicable in cases where the copyrighted material is purchased with an intent to distribute, but Bart doesn't give us posters anything of monetary value for our posts, so the implied copyright wouldn't be applicable in that sense either.

Legally, I don't think that Bart would have a leg to stand on in regards to not allowing an original author to edit or remove their work since he has no purchased the work. However, I will admit that I'm an auditor, not a lawyer, so I am not the most qualified person to give legal opinions.

I can't really think of any legal precedent off the top of my head, I guess OPG v. Diebold would be the closest case (if online material is protected under the fair use doctrine, it doesn't have to be taken down). The question here would be whether our copyrighted material still fits within the scope of the fair use doctrine, which I would argue it does not (since bart gives the user full copyright over any material submitted...but again, the case isn't an exact fit. This may be subject to the content of the specific material in question.

By the way, there is a way to delete your own posts described here, http://www.ubersite.com/m/84810 which actually works (http://www.ubersite.com/m/2000) but you can't do all your posts at once. I'd try deleting handfuls at a time. I've deleted a post where I posted a picture of myself because I figured I was better off without having my photo in public domain. Unfortunately, there isn't a way to delete your account or comments, but your posts are in fact deletable.

Terms or no terms, copyright or no copyright, when you hit that little submit button, there's the implicit agreement that you're transferring the content of your post for publishing on this website. There's nothing anywhere that would lead you to believe there are any time limitations on this agreement.

When you voluntarily post anything on the internet, there's the implication that it's going to live forever electronically. I'm not sure that it will hold up in court, but a good lawyer could easily argue that point.

rob- that's a horrible legal argument. and I "sign"ed up when i was 16...that means that any legal contract would need parental consent. which there isn't any.

scourge- the naked pics aren't great, but I can live with it. there's actually just a couple posts where i said other's names, and that was irresponsible of me. I've asked him to allow me just to edit them slightly, or remove those, but he hasn't responded.

it comes down to it- if it truly is my property, and my copyright, then i have the right to do with it what i want. if he keeps it forever on his site, doesn't that in effect make it his property?

Your age has nothing to do with your capacity to contribute material to the collective. I mean, from what I can see - your posts are mostly shit anyway so it's not like they will be missed, but it's the principle of the thing. It's been that way from the beginning and you could have stopped posting at any time - and certainly could have moderated your behaviour in such a way as to not regret having posted things you would like removed.

Personally I think Bart should simply charge a fee to remove or edit material on Ubersite. Do something like 20 bucks to remove a post and 5 dollars to edit it.

If you wanted out you could pay the $4,000 bucks it would cost to wipe your slate clean.

Publishing a book is quite a lot different than posting to a website. Including signing a contract with a publisher. And yes, if you had worked the contract right, you could get it to stop being distributed, at least legally.

So if you wrote a book and had it published when you were 16 and then decided a couple years later that you didn't feel like it being distributed any more you would be able to wander into the bookstore and ask the vendor to remove the book?

You could try and sue - and I bet with enough legal pressure Bart would remove your account - but that would only be after you wasted lots of money on a lawyer and ensuing legal fees.
